Not all appeals occur after a case reaches its conclusion. Litigating a civil case begins before the actual trial commences. Disputes arise during the discovery phase and during pre-trial hearings, and an adverse ruling by the trial court judge on these matters can play a huge role in determining the outcome of a case.
Pre-trial rulings can be appealed through the use of writ petitions requesting a higher court to sustain or reverse a lower court ruling. Writ petitions are heard at the discretion of the appellate court and are only granted when there is no other adequate remedy available to the party requesting relief and the petitioner will suffer irreparable injury if the lower court ruling is not reversed. As an experienced civil litigator and appellate attorney, I have vast knowledge of how to promote my clients’ positions before an appellate court by either filing writ petitions or defending against them.
